By accessing or using the Vektorone website, platform, services, or any associated advertising technology solutions (collectively, the "Services"), you agree to be bound by these Terms and Conditions of Use ("Terms"), all applicable laws and regulations. If you do not agree with any of these Terms, you are prohibited from using or accessing the Services. The materials and services contained herein are protected by applicable copyright, trademark, and other intellectual property laws.

2. Description of Services

Vektorone provides advertising technology solutions, which may include but are not limited to: programmatic advertising services, ad serving, ad exchange platforms, demand-side platforms (DSP), supply-side platforms (SSP), data management platforms (DMP), audience targeting, analytics, and related advertising technology tools and services.

3. License and Use Restrictions

Subject to these Terms, Chameaux Blue Inc. grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes. Under this license, you may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any information, software, products, or services obtained from the Services;

  • Use the Services for any unlawful purpose or in violation of any applicable laws or regulations;

  • Use the Services to transmit any fraudulent, misleading, or deceptive advertising content;

  • Attempt to decompile, reverse engineer, or disassemble any software or technology used in providing the Services;

  • Remove any copyright, trademark, or other proprietary notices from any materials;

  • Transfer your account or any rights under these Terms to any third party;

  • Use automated systems, bots, or scrapers to access the Services without express written permission;

  • Engage in any activity that interferes with or disrupts the Services or servers;

  • Use the Services to generate invalid clicks, impressions, or conversions (ad fraud);

  • Circumvent, disable, or otherwise interfere with security-related features of the Services.

This license may be terminated immediately if you violate any of these restrictions and may be terminated by Chameaux Blue Inc. at any time at its sole discretion. Upon termination, you must cease all use of the Services and destroy any downloaded materials in your possession.

4. Advertising Content Standards

When using Vektorone's Services for advertising purposes, you agree that all advertising content must:

  • Comply with all applicable federal, state, and local laws and regulations, including but not limited to FTC guidelines, COPPA, CAN-SPAM, and CCPA;

  • Not contain false, misleading, or deceptive claims;

  • Not infringe upon any third-party intellectual property rights;

  • Not contain malware, spyware, or any malicious code;

  • Not promote illegal products, services, or activities;

  • Not contain content that is defamatory, obscene, or discriminatory;

  • Comply with all applicable advertising industry self-regulatory guidelines (IAB, NAI, DAA).

Chameaux Blue Inc. reserves the right to reject, suspend, or remove any advertising content that violates these standards at its sole discretion.

5. Data Usage and Advertising Technology

By using our Services, you acknowledge and agree that:

  • Vektorone may collect, process, and use data for advertising targeting, measurement, and optimization purposes;

  • Data collected may include device identifiers, IP addresses, browsing behavior, ad interaction data, and other information as described in our Privacy Policy;

  • You are responsible for ensuring that your use of the Services complies with all applicable data protection and privacy laws;

6. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CHAMEAUX BLUE INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

CHAMEAUX BLUE INC. DOES NOT WARRANT THAT:

  • The Services will meet your requirements;

  • The Services will be uninterrupted, timely, secure, or error-free;

  • The results obtained from the Services will be accurate or reliable;

  • Any errors in the Services will be corrected.

7. Limitation of Liability

IN NO EVENT SHALL CHAMEAUX BLUE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Services;

  • Any conduct or content of any third party on the Services;

  • Any content obtained from the Services;

  • Unauthorized access, use, or alteration of your transmissions or content;

  • Any advertising campaign performance or results.

IN NO EVENT SHALL CHAMEAUX BLUE INC.'S TOTAL LIABILITY EXCEED THE AMOUNTS PAID BY YOU TO CHAMEAUX BLUE INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless Chameaux Blue Inc., its officers, directors, employees, agents, suppliers, and partners from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Services;

  • Your violation of these Terms;

  • Your violation of any applicable laws or regulations;

  • Your advertising content or campaigns;

  • Your violation of any third-party rights, including intellectual property or privacy rights.
